1. General

1.1 Your contractual partner for all orders is multitaskin feinfood GmbH, Dürrbergstr. 17d, 4132 Muttenz. The conditions are accessible to everyone and can be found on the Oil & Vinegar Webshop CH website www.oilvinegar.ch. If requested, we will send you a written copy.

1.2 Our website is not an offer in the legal sense, but rather an invitation to make an offer. By placing your order using the “Send order” button, you are making a binding offer to conclude a purchase contract. Immediately afterwards you will receive an email confirming receipt of your order. Acceptance of your order and thus the conclusion of the contract takes place upon delivery of the goods.

1.3 By accepting via the “Order” button, you confirm that you agree to the delivery and payment conditions. Oil & Vinegar Webshop CH reserves the right to change the delivery and/or payment conditions.

1.4 With regard to all contacts, sales and other things that came about as part of the Oil & Vinegar Webshop CH, the general terms and conditions listed here apply exclusively. General or special provisions or conditions of third parties have no validity and are hereby excluded.

1.5 Oil & Vinegar Webshop CH is not a contractual partner for purchase contracts that you conclude via external sites to which we merely provide access via a link. The conditions of the respective provider apply to these orders.

2. Delivery

2.1 Orders in Oil & Vinegar's Swiss webshop can currently only be placed in German, English and French. We only ship to delivery addresses within Switzerland. Please note that the billing address must also be within Germany.

2.2 Your order will be delivered by Swiss Post. If you are not at home at the time of delivery, you will find a notification in your mailbox. In this case, please contact our service partner (Post). You can find the telephone number and further information on the notification slip.

2.3 If possible, you will receive your order in a single shipment. There are no disadvantages for multiple shipments; Oil & Vinegar Webshop CH will cover the additional postage and packaging costs. If an item is not available, we will inform you on the invoice or you will receive a separate written notification.

2.4 Your order will be delivered within 5 working days. If this is not possible (because the ordered goods are out of stock or no longer in the range), or for other reasons there is a delay or an order cannot be implemented or can only be partially implemented, Oil & Vinegar Webshop CH will contact you to process the order to change or to agree on a different delivery time. If you do not agree, you have the right to cancel the order and the full purchase price will be refunded. If it happens that an item you ordered arrives defective, please contact our customer service. The contact information can be found in the documents accompanying the article.

3. Shipping costs

Our shipping costs per order are Fr. 7.90. If the order is delivered in several shipments, you will not suffer any disadvantages; Oil & Vinegar Webshop will cover the additional postage and packaging costs.

4. Price information / payment options / retention of title

4.1 All prices include VAT and do not include shipping costs.

4.2 The prices will not be increased within the term of the offer, unless legal requirements make this necessary.

4.3 If prices are stated incorrectly due to input errors, there is no legal right to delivery of the goods at the incorrectly stated price.

4.4 The following payment methods exist: Postfinance Card and the credit cards Visa and MasterCard, Twint.

4.5 The goods remain the property of multitaskin feinfood GmbH (Oil & Vinegar Webshop CH) until full payment has been made.

5. Right of withdrawal

Right of withdrawal for consumers (any natural person who concludes a legal transaction for purposes that cannot predominantly be attributed to their commercial or independent professional activity.)

5.1 Cancellation policy
You have the right to cancel this contract within fourteen days without giving reasons. The cancellation period is fourteen days from the day on which you or a third party named by you who is not the carrier takes possession of the goods. In order to exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract. In order to meet the cancellation period, it is sufficient that you send the notification of your exercise of the right of cancellation before the cancellation period expires.

5.2 Consequences of cancellation
If you cancel this contract, we will have to pay you all payments that we have received from you, including delivery costs (with the exception of additional costs resulting from you using a different type of delivery than that have chosen the cheapest standard delivery offered by us) immediately and at the latest within fourteen days from the day on which we received notification of your cancellation of this contract. For this repayment we use the same payment method that you used for the original transaction, unless something different was expressly agreed with you; under no circumstances will you be charged any fees as a result of this repayment. We may refuse repayment until we have received the goods back or until you have provided evidence that you have sent the goods back, whichever is the earlier.

You must return or hand over the goods to us immediately and in any case no later than fourteen days from the day on which you informed us of your cancellation of this contract. The deadline is met if you send the goods before the deadline of fourteen days has expired.

You bear the direct costs of returning the goods.

You are only liable for any loss in value of the goods if this loss in value is due to the handling other than what is necessary to establish the nature, properties and functionality of the goods.

5.3 Exclusion of the right of withdrawal for:

Contracts for the supply of goods which are not prefabricated and for the production of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer;

Contracts for the delivery of goods that can spoil quickly or whose expiry date would quickly be exceeded;

Contracts for the delivery of alcoholic beverages, the price of which was agreed upon conclusion of the contract, but which can be delivered no earlier than 30 days after conclusion of the contract and whose current value depends on fluctuations in the market over which the entrepreneur has no influence;

Contracts for the delivery of newspapers, magazines or magazines with the exception of subscription contracts

5.4 Early expiry of the right of withdrawal at:

Contracts for the supply of sealed goods which are not suitable for return for health or hygiene reasons if their seal has been removed after delivery;

Contracts for the delivery of goods if, due to their nature, they were inseparably mixed with other goods after delivery;

Contracts for the delivery of audio or video recordings or computer software in a sealed package if the seal has been removed after delivery;

Contracts for the purchase of digital content that are located on a physical data carrier, provided that the customer has expressly agreed that the entrepreneur will begin executing the contract before the end of the cancellation period and the customer has confirmed his knowledge of this his consent loses his right of withdrawal when the execution of the contract begins.

6. Encryption

All personal data such as your address or credit card details are encrypted via SSL and are therefore "eavesdropping" when transmitted via the Internet.

7. Warranty

7.1 The statutory warranty provisions apply. If the goods you ordered are used for your own commercial or independent professional activity, your claims under the statutory warranty provisions expire in one year. Any guarantees from the respective manufacturer or from multitaskin feinfood GmbH (Oil & Vinegar Webshop CH) do not affect the warranty provisions.

8. Privacy and Security Notice

Your data will be used and processed exclusively within the framework of applicable data protection laws. We would like to point out that your order data is stored by us but can no longer be accessed by you after you have submitted your order. After placing your order, you will receive an email informing you that your order has been received.

9. Pictures and specifications

All illustrations, pictures, drawings – e.g.b Data about weight, dimensions, colors, graphics, labels, etc. - on the Oil & Vinegar Webshop CH website are only approximate, are guidelines and do not entitle you to claim damages or withdraw from the agreement.

10. Force majeure

10.1 Oil & Vinegar Webshop CH is not liable if the obligations cannot be fulfilled due to force majeure.

10.2 Oil & Vinegar Webshop CH reserves the right, in the event of force majeure, to suspend its obligations, to suspend delivery in whole or in part, or to make a change to the delivery in consultation with the customer.

10.3 A penalty or compensation payment by Oil & Vinegar Webshop CH is excluded in any case.

10.4 If deliveries or partial deliveries have already been made before the force majeure occurs, Oil & Vinegar Webshop CH is entitled to invoice the parts that have already been delivered or can be delivered separately. This does not apply if the delivered or deliverable parts have no independent value.

11. Liability

Oil & Vinegar Webshop CH is not liable for damage caused by improper use of the products. Please read the instructions on the packaging.

12. Defects

12.1 In principle, you are entitled to statutory claims for defects, but with the following restriction when claiming damages: Claims for compensation for damage that did not arise from the delivery item itself are excluded. This exclusion of liability does not apply in the event of intent, gross negligence, culpable violation of essential contractual obligations, in cases of liability under the Product Liability Act and in the assumption of a guarantee for the existence of properties as well as in the event of damage to people's bodies and health. In the event of a culpable violation of essential contractual obligations, we are only liable for contract-typical, reasonably foreseeable damage. No compensation will be provided for lost profits. Claims for defects expire within the statutory period of 24 months.

12.2 For orders placed by entrepreneurs, the obligation to inspect and give notice of defects in accordance with Section 377 of the German Commercial Code (HGB) and a limitation period of 12 months apply, starting with delivery of the item.

12.3 The elimination of defects or the delivery of a fault-free replacement piece ("supplementary performance") takes place without recognition of a legal obligation and does not lead to a new start of the statute of limitations. We will bear any additional costs incurred in the event of defects in the ordered goods, in particular for transport, labor and materials, unless it emerges from checking the alleged defects that there is no claim due to defects. In this case, you are obliged to reimburse the costs incurred by the examination.

12.4 An independent guarantee for specific properties of the goods sold does not lie in the information about the goods available on the website. We will not accept it otherwise.

13. Severability clause

If individual provisions of these General Terms and Conditions are ineffective or void, the effectiveness of the remaining provisions will not be affected.

14. Governing Law

14.1 Only Swiss law applies to sales.

14.2 To the extent permitted, the place of jurisdiction for all legal disputes regarding contracts that are subject to these terms and conditions is the relevant court responsible for our registered office.
